Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of the platform operated by 1773 Human Resources & Marketing Services LTD (“1773,” “we,” “us,” or “our”), including our website, candidate/employer/agency dashboards, and our WhatsApp assistant (together, the “Platform”).

By creating an account, posting a job, submitting a talent request, applying to a job, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform. For information on how we handle personal data, see our Privacy Policy.

2. Who can use the Platform

The Platform is available to candidates seeking employment, employers seeking to hire, and recruitment agencies operating on behalf of their own clients. You must provide accurate information when creating an account and are responsible for keeping your login credentials confidential. You are responsible for all activity that happens under your account.

3. Candidate accounts and job applications

Candidates may create a free profile or upgrade to a paid profile package for greater visibility, as described on our Pricing page. Applying to jobs and using the core job-search features of the Platform is free for candidates.

You are responsible for the accuracy of the information in your profile, CV, and any declarations you make when applying to a role. Submitting false, misleading, or fraudulent information may result in suspension or termination of your account.

Creating a profile or applying for a job through the Platform does not guarantee you an interview or a job offer. Hiring decisions are made by the employer or agency, not by 1773.

4. Employer and agency accounts, job postings, and talent requests

Employers and agencies may post jobs directly on a self-serve, paid basis, or request that our consultancy team source and shortlist candidates on a managed, fee-based basis, as described on our Pricing page. Fees for each service model are shown at the time of purchase or agreed separately for managed engagements.

You agree that job postings and talent requests you submit are for genuine, lawful vacancies, and will not be used to collect candidate data for any purpose other than legitimate recruitment. We reserve the right to review, edit, decline, or remove any job posting that we reasonably believe is fraudulent, discriminatory, misleading, or otherwise violates these Terms or applicable law.

Where you pay to unlock a candidate's contact and profile details from our wider database, that access is for the purpose of considering that candidate for a genuine vacancy, not for resale, unsolicited marketing, or any other purpose.

Agencies represent and warrant that they have the authority to act on behalf of the clients for whom they submit talent requests or manage postings on the Platform.

5. Payments

Paid features (including self-serve job postings, candidate profile packages, and candidate-detail unlocks) are processed through Paystack. By making a payment, you agree to Paystack's applicable terms for processing that transaction in addition to these Terms.

Fees are shown in Ghana cedis (GHS) unless stated otherwise and are due at the time of purchase. Except where required by law or expressly stated otherwise, fees already paid for a service that has been delivered (such as a live job posting or an unlocked candidate profile) are non-refundable. If you believe you were charged in error, contact us at admin@1773hrconsultancy.com and we will review the matter in good faith.

6. The WhatsApp assistant

Our WhatsApp assistant helps with account creation, job search, application and hiring status updates, and general questions, and can hand you off to a staff member. Do not send your account password or full payment card details through WhatsApp; account creation and payments are always completed through secure, dedicated flows on the Platform, never through chat.

Message and data rates from your mobile network provider may apply to your use of WhatsApp.

7. Acceptable use

When using the Platform, you agree not to:

• Impersonate another person or organization, or misrepresent your affiliation with any company or agency.
• Post or apply to jobs that are fraudulent, scams, or seek to obtain money, fees, or personal financial information from candidates outside of legitimate salary and business arrangements.
• Harvest, scrape, or extract data from the Platform other than through your normal, intended use of it.
• Upload content that is unlawful, defamatory, discriminatory, or infringes on someone else's rights.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Platform, its accounts, or its underlying systems.

8. Intellectual property

The Platform, including its design, branding, and underlying software, is owned by 1773 or our licensors and is protected by applicable intellectual property laws. You retain ownership of the content you submit (such as your CV or job postings), and you grant us a license to use, display, and process that content as needed to operate the Platform and provide our services to you.

9. Account suspension and termination

We may suspend or terminate your account if you violate these Terms, provide false information, misuse the Platform, or engage in fraudulent or abusive conduct, including scam job postings or attempts to defraud candidates. You may close your account at any time by contacting us; certain records may be retained as described in our Privacy Policy.

10. Disclaimers and limitation of liability

The Platform is provided on an “as is” and “as available” basis. We do not guarantee that any candidate will be hired, that any job posting will result in suitable applicants, or that the Platform will be uninterrupted or error-free. 1773 acts as a platform connecting candidates, employers, and agencies; we are not a party to the employment relationship formed between an employer and a candidate, except where we are separately engaged for a managed recruitment service.

To the fullest extent permitted by law, 1773 will not be liable for indirect, incidental, or consequential damages arising from your use of the Platform. Nothing in these Terms limits any liability that cannot be limited under Ghanaian law.

11. Changes to these Terms

We may update these Terms from time to time as our Platform and services evolve. We will update the effective date at the top of this page when we do, and, where changes are significant, we will take reasonable steps to notify registered users. Continued use of the Platform after a change takes effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Ghana. Any dispute arising from these Terms or your use of the Platform will be subject to the jurisdiction of the courts of Ghana.
